General Terms and Conditions 

01. general
All deliveries and services of the company kaffee-total are exclusively based on these terms and conditions.

02. conclusion of contract
Our offers are non-binding and subject to change. Characteristics of the goods and services, prices are described directly in connection with the offered product.

By clicking on the "Order" button, the customer makes a binding declaration that they wish to purchase the contents of the shopping basket. After submitting the form, you will receive confirmation that your order has been received. This is not yet a binding order confirmation. You will receive this at the latest when the goods are delivered.
Prices: 
When new prices appear, all previous prices lose their validity.
All prices quoted include the statutory value added tax (VAT) plus shipping costs if applicable.

However, for orders under EUR 75.00 we charge a flat rate of EUR 5.95 for shipping and handling.

The prices for the coffee also include the coffee tax of EUR 2.19 / kg which is mandatory in Germany 

Minimum order value: 
You do not have to order items from us for a specific value. However, we charge a flat rate of EUR 5.95 for shipping and handling for orders under EUR 75.00. 

03. right of cancellation and cancellation policy
If the customer is a consumer, the following applies:

04. payment and offsetting
Invoices of the company kaffee-total are due immediately and payable without any deduction. Offsetting is only permitted with undisputed or legally established claims.

Deliveries abroad: 
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods: 
For deliveries abroad, the costs for packaging and transport will be charged. 
We ship abroad with DPD DHL or Swiss Post. The respective import regulations of the recipient country will be taken into account.
Deliveries to Switzerland are made by Swiss Post. The order will then be cleared directly by us at German/Swiss customs. 

Deliveries within the EU: 
The currently valid VAT of the Federal Republic of Germany applies here 
If you as an entrepreneur have a VAT ID number, the German VAT will not be charged 
Deliveries to non-EU countries: 
The German VAT will not be charged 
However, you will have to pay the respective import VAT at your customs office - unfortunately, we cannot provide you with any information about customs costs. 
Deliveries to Switzerland are cleared directly at the Swiss border, you will receive a separate invoice from us for the costs incurred.
Payments for deliveries abroad can only be made:

Any costs incurred for foreign payment transactions will be borne by the buyer and charged subsequently.

05. warranty
The warranty is governed by the statutory provisions.
For household appliances that are used exclusively in the household, the warranty period is 24 months. 
In the case of used appliances or demonstration appliances, the warranty period is 12 months. 

No warranty is provided for: 
all parts that are subject to natural wear and tear. These include seals, valves, heating resistors, switches and temperature regulators.
Defects caused by weathering, scale build-up, chemical, physical, electromechanical or electrical influences, provided they are not attributable to our fault. 
if operating and maintenance instructions are not followed, changes are made to the product, parts are replaced or consumables are used that do not correspond to the original specification, or if independent repair attempts are made. 
Damage due to third-party intervention 

If the contract is cancelled for any legal reason whatsoever, we shall be entitled, without prejudice to any other claims that may exist against the buyer, to demand the following amounts for the use and use of the goods and as compensation for depreciation:
25 % of the purchase price within the 1st quarter
30 % of the purchase price within the 2nd quarter
40 % of the purchase price after one year
50 % of the purchase price after 18 months

Transport damage/defects: 
Transport damage: 
In the case of immediately recognisable damage that has obviously been caused by transport, we ask you to have this confirmed by the deliverer upon receipt of the goods. 
We also request that you notify us of the damage, stating your order details.  

Other complaints: 
Please notify us of the damage or defect within 2 days. 
If a consignment arrives incomplete, please also notify us within 2 days. An immediate subsequent delivery will of course be made free of charge. 

06. retention of title
The object of purchase remains our property until the purchase price has been paid in full.

07. data protection
Insofar as it is possible to enter personal data, this will be treated confidentially and in compliance with data protection regulations. Personal data will only be collected and used insofar as this is necessary for the content or processing of the respective contractual relationship. The user can request information about the personal data stored about him at any time. Furthermore, the user may request the deletion of his or her stored personal data, provided that the contractual relationship has been fully processed and the storage of the data is not prescribed.

08. final provisions
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

If the contractual partner is a merchant, a legal entity under public law or a special fund under public law, our registered office is agreed as the exclusive place of jurisdiction for all claims arising from or on the basis of this contract. The same applies to persons who do not have a general place of jurisdiction in Germany or persons who have moved their domicile or usual place of residence outside Germany after conclusion of the contract or whose domicile or usual place of residence is not known at the time the action is brought.

Should a provision of this agreement be wholly or partially invalid or lose its legal validity at a later date, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the statutory provisions.
